The High Court has extended orders barring the arrest of businessman Jimi Wanjigi until September 19. The ruling, issued by Justice Bahati Mwamuye, provides temporary relief for Wanjigi, who is facing possible criminal charges.
However, Justice Mwamuye emphasized that the court could not prevent the registration of a charge sheet against Wanjigi, as the current application focused solely on his arrest, not his prosecution.
Wanjigi’s advocate, Willis Otieno, sought the extension during a court session this morning, arguing that recent developments might necessitate amendments to the existing application.
“Several things have happened that we will be seeking to bring to the attention of this court that will necessitate amendment of the application. That’s why we are pleading for the order. There will be no prejudice to be suffered.”
The Director of Public Prosecutions (DPP) opposed the request, contending that Otieno was attempting to obtain relief beyond the scope of the original application.
“They are trying to preempt our grounds of opposition in which we indicate they have failed to demonstrate how we have threatened the rights of the petitioner. I am opposed to granting an order that will bar charges,” said the DPP.
The case is scheduled for mention on September 19, when further directions on the matter will be given.
