Graft charges against DP Gachagua withdrawn

An Anti-corruption court has allowed an application by the ODPP to withdraw the 7.5 billion Sh graft case against Deputy President Rigathi Gachagua, citing lack of evidence.

Magistrate Victor Wakumile warned and informed the accused persons that they may be re-arrested in future on similar charges.

There being no objection to the substantive application by the prosecution to have the matter withdrawn under section 87 A of the criminal procedure code, is hereby granted,” Victor said.

He added that charges cannot be pressed on the anticipation of getting evidence.

According to the court, the 12 million sh bail Gachagua deposited in court as a condition for his release when he was charged should be returned to him.

Additionally Gachagua’s passport together with those for his co-accused will be returned.
