Court rejects case bidding Kenyans with dual citizenship to join KDF

The High court has dismissed a case seeking to have Kenyans with Dual citizenship join Kenya Defense Forces.

 According to Justice Hedwig Ong’udi, the court has no power to meddle in national security issues.

The case, which was filed by Busia senator Okiya Omtatah, was asking the court to declare the decision to bar Kenyans with dual citizenship from joining KDF, unconstitutional.

 Omtatah added that the article of the constitution banning this move, has a rider that exempts any person who has been made a citizen of another country by operation of that country’s law, without the ability to opt-out.

The court heard that there has never  been any holder of dual citizenship who has presented him or herself for consideration for enlistment into KDF.
