The Court of Appeal has dismissed a petition by National Assembly Speaker Moses Wetang’ula seeking to overturn a High Court ruling that declared the Azimio La Umoja-One Kenya Coalition as the majority in Parliament.
A three-judge bench ruled on Friday, 21st March 2025, that granting conservatory orders would amount to endorsing Wetang’ula’s claim that Kenya Kwanza remains the majority. The court also stated that doing so would interfere with the ongoing High Court case.
The judges rejected claims that the February 7 High Court ruling had disrupted National Assembly operations, stating there was no sufficient evidence to support the assertion.
Additionally, the Appellate Court declined to rule on Wetang’ula’s dual role as both Speaker and Ford Kenya leader, stating that such a determination could not be made at this stage.
The ruling follows the High Court’s earlier decision that Wetang’ula violated the law by declaring Kenya Kwanza the majority on 6th October 2022, despite the Registrar of Political Parties’ report showing Azimio had more affiliated parties.
The case now returns to the High Court for further deliberation.
