The High Court has granted Mombasa Lands County Executive Committee (CEC) member Mohammed Hussein a Ksh1 million anticipatory bond in connection with the alleged assault of blogger Bruce John.
High Court Judge Wendy Kagendo ruled in favor of Hussein’s application, preventing his arrest until the case is heard.
“The applicant is hereby granted a bond of Ksh1 million with one surety and contact person,” High Court Judge Wendy Kagendo ruled.
Hussein was also offered an alternative cash bail of Ksh500,000, with conditions that include surrendering his passport, providing two contact persons, and obtaining court permission before leaving the country.
He must also report to the Directorate of Criminal Investigations (DCI) for further questioning and failure to comply with these terms could lead to a warrant for his arrest.
“If Hussein fails to comply with the summons and there is sufficient evidence of service then a warrant of arrest shall be issued,” the Court added stressing the need for Hussein to cooperate during the investigations that will take six months.
The charges stem from an incident where blogger Bruce John was reportedly assaulted after criticizing the Mombasa governor Abdulswamad Nassir on social media.
Additionally, Hussein is linked to a gang-rape allegation involving the same blogger.
Mombasa Governor Abdulswamad Nassir however distanced himself from the accusations, labeling them as politically motivated.
He has recorded a statement with the DCI, denying any involvement in the alleged incident.
