Embakasi East Member of Parliament Babu Owino has been acquitted in a case in which he was charged with misusing his firearm in relation to the shooting of DJ Evolve.
Magistrate Bernard Ochoi said the prosecution did a shoddy job as no evidence was produced to prove the charges levelled against Babu.
After analyzing the evidence produced in court, Ochoi identified two issues for determination in the case.
A CCTV that circulated soon after the shooting was dismissed.
The magistrate said the prosecution failed to record even a statement of the victim and the ballistic evidence produced in court was scanty and the same could not be relied upon to find the MP guilty.
He said that the prosecution failed to convince the court that the MP was involved in the shooting.
The prosecution didn’t produce medical reports as regards to samples and tests that were taken at the scene on 17/04/2020 when the incident occurred.
Police officers involved in the probe said they were unable to link Babu’s gun with the bullet that shot DJ Evolve.
In his defense, Babu told the court he had spent Sh58.6 million to take care of medical bills and upkeep of DJ Evolve.
The MP said he took responsibility for Evolve as a sign of his moral obligation as a leader.
The Embakasi East MP has promised to walk by Felix Orinda aka DJ Evolve in his journey to recovery.
Speaking at Milimani Law Courts after he was acquitted of the charges of misuse of firearm on Tuesday, Owino said he was planning on paying for the DJ’s further treatment overseas.
“I will walk by DJ Evolve. I will always be there for him. I’m planning to take him to India for further treatment,” he said.
“I pray to the Almighty God to grant him spiritual and physical strength,” he added.
The court has ordered that cash bail paid by the MP as well as his passport be released to him.
