The lawyer to Azimio presidential candidate Raila Odinga – Philip Murgor says the Independent Electoral and Boundaries Commission (IEBC) is yet to give them access to all its servers as ordered by the Supreme Court.
Addressing the Judges hearing and determining the presidential petition challenging President-Elect William Ruto’s win, he noted that IEBC has continued to refuse to provide the forensic image of all its eight servers to the Azimio team.
This comes after the commission on Wednesday said it had granted Azimio access to the servers.
“Nothing has changed. IEBC has continued to refuse to provide the forensic image of all 8 servers. We are concerned that the delay is for the commission to delete vital data,” he said.
He noted that the electoral body only provided access to one server, of which they were able to observe a number of irregularities.
“With the limited access provided, our team was able to observe a large number of deletions,” said Murgor.
While responding to Murgor, Justice Isaac Lenaola however said the court was aware that the process of compliance by the IEBC had been completed, and that the Azimio team has access to all the IEBC servers.
He said the Supreme Court was waiting to receive the report on the matter come Friday from its team present at the IEBC offices.
“We have been informed that the process of compliance was completed last night… as far as our team is concerned the process at IEBC is finished,” said Lenaola.
“The court has asked me to respond that should there be issues left unattended too, let those issues be addressed when we receive the report. You can address the question of what you are calling non compliance, the questions on what servers were not accessed and IEBC can respond to say what are you answers to the complains by the petitioners .Then the court will determine what the import of what you are saying,” he added.
