High Court Dismisses Case Seeking Ruto’s Removal from Office

The High Court has dismissed a petition filed by Michael Kirungia seeking the removal of Deputy President William Ruto from office.

The application which accused Ruto of neglect of duty was thrown out on the grounds of non-justiciability. 

Justice Anthony Mrima argued that the process of removing a sitting DP is not within the jurisdiction of the court and can only be done by Parliament.

“We submit that the only organ with the power to remove a sitting Deputy President from office is parliament through impeachment as provided for under Article 150 of the Constitution,” said Mrima.

Kirungia claimed Ruto had abandoned his constitutional role as the second in command and embarked on self-assigned duties.

He had also asked the court to restrain the DP from using his office and residential home in conducting United Democratic Alliance meetings until the case is heard and determined.

The court has now asked Kirungia to pay the costs of the case.

This comes after the DP in June called on the court to dismiss the case saying that only Parliament can remove him from office through impeachment.
