The jubilee party has nominated Sammy leshore as the replacement of nominated senator Isaac Mwaura representing persons with disabilities.
In a gazette notice, IEBC chairman Wafula Chebukati says the name of Isaac Mwaura as nominated senator stands disqualified and has been replaced by Leshore.
This is despite an interim court order issued last evening against his removal.
Milimani law court Judge Joseph Sergon issued the injunction restraining the implementation of the judgement of the political parties tribunal.
The injunction was issued last week Friday until Mwaura’s case is heard and determined.
Judge Sergon also barred the implementation of the gazette notice issued yesterday.
The judge certified Mwaura’s motion as urgent after considering the grounds he stated in his affidavit.
He also ruled that the motion be heard on the 24th of this month.
Speaker Lusaka had declared Mwaura’s seat vacant yesterday, following a decision by the Jubilee party to expel him on grounds of disloyalty and trading allegiance.
