Court of appeal Suspends High court ruling to stop Chief justice recruitment

The Court of Appeal has suspended the orders issued by the High Court barring the recruitment of the next Chief Justice & Supreme Court judge.

In the ruling, court of appeal judge Justice Patrick Kiage said they their orders were in public interest.

He added that the case in the high court could always be continued even after the process is over.

The ruling means that the Judicial service commission is free to nominate one person for the position of chief justice after conducting interviews of ten candidates.

The nominee will also be vetted by the national assembly before being appointment by President Uhuru Kenyatta.

The JSC will also conduct the interviews of the judge of the supreme Court to replace Jackon Ojwang who is retired .

The four petitioners in the high court had challenged Olive Mugenda position as chair of the JSC during the interview.

They also questioned the presence of commissioner Patrick Gichohi who has since retired from public service.
