Ex-Chief Justice Maraga sues Senior Counsel for defamation

Feb, 25th 2021 – Retired Chief Justice David Maraga has sued Senior Counsel Ahmednasir Abdullahi for defamation.

In a civil suit filed at a constitutional division of the High Court at Nairobi’s Milimani Law Courts, Justice Maraga accused the lawyer of defaming him by claiming he shielded a Supreme Court judge who received a Sh220 million bribe.

Maraga argued that the tweet post by Ahmed Nasir has caused him anxiety, painting his name in bad light having worked in the Judiciary as a judge of the High Court, Court of Appeal, and Chief Justice and President of the Supreme Court.

Maraga noted that the tweet is still visible in Nasir’s account.

In his suuit papers, Maraga quoted the tweet that stated, “If CJ Maraga is a decent and honest Kenyan, he should come clean on the issue of the SENIOR judge of the SUPREME COURT who took Ksh.220 million BRIBE. Me and CJ Maraga know the judge…intelligent Kenyans must read A LOT on Maraga’s astute silence on this matter.”

On the basis of the tweet’s attraction, Maraga through his lawyers Tripleok Law LLP wrote to the senior counsel on the 26th of January requesting him to pull down the tweet and offer an apology on twitter failure to which he will face legal action.

Maaraga said, “The plaintiff has been disgraced, humiliated, subjected to untold embarrassment and ostracized in his personal capacity and professional standing as a retired CJ.”

According to Maraga, the tweet implied that he is not an honest Kenyan. The tweet implied that he was aware of the alleged bribery by a supreme court judge. The tweet also implies that he committed an offence by failing to disclose the matter.
