The High Court has issued a conservatory order stopping the recruitment of several key positions at the Social Health Authority (SHA) following a legal challenge by the Kenya Union of Clinical Officers (KUCO).
Justice Lawrence N. Mugambi of the Milimani Law Courts granted the order after KUCO filed a petition questioning the legality of the hiring process. The judge directed that the petition and supporting documents be served by the close of business on March 24, 2025, with responses to be filed within three days. The court order bars SHA, its employees, officers, and agents from proceeding with the recruitment until the case is heard and determined.
The hiring process in question sought to fill critical positions, including Assistant Director County Coordination, Director Benefits Management, and Principal Officers for county and beneficiary management roles.
KUCO, through its Secretary-General George Gibore, argued that the recruitment process was unlawful and required judicial intervention to ensure compliance with proper procedures.
The court has scheduled the next hearing for April 10, 2025, where further directions on the matter will be given.
