Embattled Deputy President Rigathi Gachagua has his fingers crossed as he awaits a crucial court ruling this afternoon on whether his impeachment at the Senate will be suspended.
Justice Chacha Mwita will at 2:30 pm rule on whether the DP will face the senate beginning Wednesday to defend himself against an impeachment bid emanating from the National assembly.
Appearing in court yesterday, Gachagua’s lawyer led by senior Counsel Paul Muite and Tom Macharia argued that the public participation process leading to the impeachment was flawed. They claimed that Gachagua’s rights were violated due to the insufficient time allocated for the process, stressing that public participation must be meaningful and conducted within a reasonable time frame.
If Justice Mwita rules in favor of Gachagua, the senate proceeding will be suspended with a case before a three judge bench empanelled by Chief Justice Martha Koome kicking off.
Koome has tasked the bench to consolidate the5 petitions challenging Gachagua’s impeachment
If Mwita rules against Gachagua, the number will be scheduled to defend himself before the Senate on Wednesday, facing 11 charges that were approved by 282 MPs in a National Assembly vote.
