Petitioner challenges law exempting churches from paying taxes

 A petition has been filed in Court challenging the exemption of churches from paying taxes, from their  tithes, offerings and donations .

A Nakuru based Doctor Magare Gikenyi  in his petition argues that the exemption violates article 201 of the constitution that expressly states that  tax burden should be shared equally among all Kenyans and in all sectors of the economy .

In the court documents, Gikenyi further states that the statute that allows exemption of tax to some sectors has been abused contrary to articles 27, 28 and 201 of the COK.

According to Gikenyi, tithes, offering and donation are classified under payments and fall under the income tax bracket.

The petitioner has also listed Non governmental institutions and Mosques as beneficiaries of the impugned law.

Kenya conference of catholic bishops, and the  Evangelical alliance of Kenya have been  listed as interested parties.

Gikenyi has asked the court to certify the petition   as urgent
