IEBC and DP Ruto lawyers submit in defense

Lawyers representing the Independent electoral and boundaries commission IEBC and those representing President-elect William Ruto have today submitted their defense in the Presidential petition.

 Professor Githu Muigai who is representing the IEBC told the Supreme Court that based on a report from election observers, the 9th of August General Election was fair, open and transparent.

He however noted that the election had a few errors, which is normally expected in any election.

He then defended the credibility of the General Election, urging the court to put into consideration the election of other holders of public office.

Lawyer Kamau Karori has refuted claims by lawyer Paul Nyamodi that IEBC chair Wafula Chebukati is a self proclaimed Presidential Returning officer.

This is after Nyamodi yesterday told the court that there is no such position as National Presidential Returning Officer.

Senior Counsel Fred Ngatia who is the lead advocate for DP William Ruto said the supreme court ought to scrutinize petitions brought before it, in order to eliminate mutations that divert the focus of hearings in court.

At the same time, Ngatia has asked the court to implore a hearing module similar to that used in Ghana while handling this case.

While seeking to find justice for DP Ruto, he urged the supreme court to look into the substantive truth of the elections, and try to achieve finality and stability.
