CJ Koome Highlights 9 Issues Surrounding Odinga’s Petition

The Pre-trial Conference at the supreme court began on Tuesday and has seen 7 petitions consolidated as one, out of the 9 petitions filed.

During the first session of the conference, rules of the petition were laid down, with Supreme Court judges insisting that only four lawyers will be allowed to represent each of the respondents.

Various lawyers taking part in the petition have already introduced themselves.

The Chief Justice Martha Koome also noted that 25 preliminary issues in the form of interlocutory actions have been disposed via online rulings.

The CJ Koome- led team framed the 7 petitions in 9 issues that will be handled in the forthcoming hearings.

Whether the technology deployed by the IEBC for the conduct of the 2022 General Election met the standards of integrity, verifiability, security, and transparency to guarantee accurate and verifiable results,


Whether there was interference with the uploading and transmissions of forms 3As from the polling stations to the IEBC public portal,


Whether there was a difference between forms 34As uploaded in the IEBC portal and forms 34As received at the national tallying center, and forms 34As issued to the agents at the polling stations,


Whether the postponement of gubernatorial elections in Kakamega and Mombasa Counties, parliamentary elections in Rongai, Kacheliba, Kitui Rural, West Pokot and electoral wards in Nyaki West in North Imenti and Kwa Njenga in Embakasi South resulted to voter suppression to the detriment of the petitioners (Raila Odinga and Martha Karua),


Whether there were unexplained discrepancies between the votes cast for presidential candidates and other elective positions.


Whether the IEBC carried out the verification, tallying, and declaration of election results in accordance with the provisions of articles 138 (3)(C) and 138 (10) of the constitution.


Whether the declared president-elect attained 50%+1 votes of the votes cast in accordance with article 138 (4) of the Constitutio.


Whether there were irregularities and illegalities of such magnitude as to affect the final result of the presidential election.


What reliefs and orders can the court grand/issue?

The court will commence its hearing on Wednesday.
