EACJ Directs AG to file response to Sonko’s appeal

The East Africa Court of Justice (EACJ) has directed Attorney General Kihara Kariuki to file a response within 45 days to the appeal lodged at the court by former Nairobi Governor Mike Sonko.

“You are hereby notified that the above-named applicant has instituted a reference against your copy which is annexed hereto,” said the court.

“You are required to file a response to reference within 45 days from the day of service hereof.  In default whereof, the reference will be heard and determined in your absence.”

This is after Sonko moved to the court seeking a review and setting aside of the Supreme Court judgment that upheld his 2020 impeachment.

Through his lawyer Danstan Omari Sonko says that he was not given a chance to be heard as required by law.

He states that the court did not consider that his impeachment appeal and the matter was not responded to since it was to be heard by five judges in Mombasa which failed to happen. 

Omari says Sonko wants the East African Court of Justice to issue interim orders stopping the execution of the judgment.

On Friday, the Supreme Court dismissed an appeal on the impeachment of former Sonko which automatically locks him out of running for the Mombasa County Gubernatorial seat.

This is as the law stipulates that a person who has been impeached is barred from holding public offices.
