ODPP Insists Waiguru’s Case File is WITH The EACC

The Office of the Director of Public Prosecution (ODPP) has refuted claims that the office is in possession of Kirinyaga Governor Anne Waiguru’s file accusing her of embezzlement of public funds.

Through a statement issued to newsrooms, The ODPP says the file is at the EACC for further investigation. 

“On 7th December 2021, the ODPP received an inquiry in relation to an inquiry into allegations of abuse of office for irregular receipt of imprest amounting to Kshs.10,634,614 against Kirinyaga County Governor Ann Waiguru. Consequently, vide a letter dated 25th March 2022, the ODPP communicated to the EACC the critical areas that require further investigations before a final decision can be made on the matter,” noted the DPP.

“The ODPP would like to clarify that the Kirinyaga County Governor Ann Waiguru’s file has since been returned to the EACC and is under active investigation; this is contrary to reports in the People Daily dated 28th June 2022 that the file is at the ODPP.”
The DPP’s office noted that investigations are still ongoing in regard to the matter and is awaiting the outcome of the investigations before a decision can be made.

“It is paramount to note that, the ODPP bears a Constitutional obligation to ensure that in every case, investigations are completed and the evidential and legal thresholds are met before making a decision to charge,” said the DPP’s office.

Governor Anne Waiguru was accused of abuse of office for irregular imprest that amounted to 10 million kenyan shillings on 7th December  last year.

The  ODPP further forwarded the file to the EACC on 25th of March, where the Twalib Mbaraka-led office confirmed to have begun investigations on 1st  of March this year.

The ODPP is awaiting the final report from the EACC to provide its prosecution.
