The High Court has dismissed an application by former Deputy President Rigathi Gachagua to suspend the hearing of his impeachment case pending the determination of his appeal.
Gachagua moved to the Court of Appeal in October last year, challenging a High Court ruling that upheld Deputy Chief Justice Philomena Mwilu’s authority to constitute a bench of judges in the Chief Justice’s absence.
The bench, comprising Justices Eric Ogola, Freda Mugambi, and Antony Mrima, ruled that it was properly constituted, prompting Gachagua to appeal. His lawyers, Paul Muite and Elisha Ongoya, argued the DCJ lacked the power to form the bench.
The High Court granted petitioners 14 days to amend their petitions and serve the respondents, who also have 14 days to file responses. The matter will be mentioned on 27th February 2025 to set a hearing date.
