High Court Suspends Impeachment of Former Deputy President Gachagua, Delaying Kindiki’s Appointment

The High Court has suspended the Senate’s resolution to uphold the impeachment of former Deputy President Rigathi Gachagua. In his ruling, Justice Chacha Mwita stated that Gachagua’s petition raised important legal and public interest concerns.

The court issued a conservatory order halting the impeachment’s implementation, including the appointment of Gachagua’s replacement, until October 24, 2024, when the case will be mentioned.

Justice Mwita certified the application filed by Senior Counsel Paul Muite as urgent and referred the case to Chief Justice Martha Koome, who will appoint a bench to hear and determine the matter.

The stay orders were issued just after the National Assembly had approved Interior CS Kithure Kindiki as Gachagua’s replacement. Kindiki’s appointment and swearing-in will now be delayed until Gachagua’s petition is resolved.
