The Deputy Inspector General of Police, Gilbert Masengeli is a free man after he convinced the the high court that he did not intentionally miss court session deliberately
The High Court set aside its initial decision to sentence the DIIG six months in prison.
While delivering the ruling, Justice Lawrence Mugambi acknowledged Masengeli’s apology tendered before the court and the turn of events after the top cop was cross-examined by advocates.
“In my observation, his apology appeared genuine. He was calm and polite. His conduct has restored the dignity of the court and administration of justice,” Mugambi said.
But what impressed the court was his genuine apology, in which he stated “I respect you and all your courts for the good work you do to uphold the rule of law. As a police officer, it is my duty to enforce court orders and ensure they are obeyed. I am deeply sorry.”
Taking the stand for the first time over the disappearance DIG told Justice Lawrence Mugambi that he was involved in national security issues that required his sole attention in the northern part of Kenya.
When put under question by the petitioners the law society of Kenya over the disappearance of Kitengela Three, Masengeli has distanced himself from their disappearance a month ago and their discovery today.
“I just learnt this morning from former LSK President Nelson Havi that the three men who were missing have been found,” Masengeli said.
According to Masengeli, he become privy to the two brothers and Bob Njagi when their disappearance was recorded in Kitengela Police Station and circulated by the OCS.
“I am informed that Jamil Longton and his brother Aslam were dumped at Gachie border of Kiambu and Nairobi by their captors,” Law Society of Kenya (LSK) President Faith Odhiambo announced.
However Judge announced his decision to rescue himself for further processing in the case citing personal reasons.
