Justice Marete Proposes an addition of two judges in the Supreme Court

Justice Marete Njagi says the Supreme Court currently has work overload.

Appearing before the Judicial Service Commission’s panel, he attributed the workload to between 100 and 250 cases pending determination before the Supreme Court.

When asked what had caused the backlog challenge, Marete cited incapacity and understaffing as a result of the long recruitment processes when a vacancy occurs.

The judge further said, proposes an addition of two judges in the Supreme Court to manage the workload at the country’s apex court.

This is a very sensible proposal that the Supreme court be improved by two other members, and maybe in the future we can move up to eleven”, said Marete.

The judge was the second interviewee, after Justice Said Chitembwe.

This comes, as the Law Society of Kenya (LSK) is accusing the Judicial Service Commission of gross misconduct, in the interviews for the Chief Justice position.

In a letter,  LSK President Nelson Havi said the hasty announcement of the nominee for the position raises concerns on the independence of the Commission.

He further said, the High Court had issued the orders, paving way for the hearing and determination of four cases challenging the recruitment process.

Among the cases challenging the process, is the suitability of Professor Olive Mugenda to serve as a Commissioner, while serving as the Chairperson of Kenyatta University Teaching and Referral Hospital, as well as the competence of Patrick Gichohi who retired from the Public Service Commission.
