Court declines to extend orders suspending Doctors’ strike

Dec, 16th 2020 – A Labour court has declined to extend order suspending the Kenya Medical Practitioners Pharmacist and Dentists Union (KMPDU) industrial action, over salary arrears from July 2017 to date.

Justice Monica Mbaru instead directed the Council of Governors, to file their response in the case by December 18th 2020. 

The judge ruled, “The claimant shall place the notice to commence industrial action in abeyance to allow respondents and interested party to reply and the respondents and interested parties have seven days to file and serve claimant with response.”

She said the matter will proceed regardless of whether they will have responded to the union’s case or not. 

The case was meant to proceed for hearing today but the Council Of Governors (COG) and Ministry of Health said they were not ready. 

KMPDU moved to court seeking to be allowed to engage on the strike pending hearing and determination of the case.

The Union urged the court to issue an order allowing the union to participate in any appropriate protected industrial action as defined in section 79 0f the Labour Relations Act in the event of non compliance of any interim orders.

Justice Monica has directed that the case be heard on the 22nd of December.
